Welcome to Boston Sailing and Fishing Charters LLC ("we," "us," or "our"). By booking a charter with us or using our website [www.bostonsailingandfishing.com], you agree to be bound by the following Terms and Conditions. Please read them carefully before making a reservation or participating in any of our services. If you do not agree with these terms, please do not use our services or website.

1. Booking and Payment

1.1. Reservation Process: All bookings must be made through our website. A booking is confirmed only upon receipt of a deposit or full payment, as specified at the time of booking.
1.2. Payment Terms: Full payment is required at the time of booking. We accept payments via credit card and other payment methods as listed in the checkout section of our website.
1.3. Pricing: All prices are listed in U.S. dollars and are subject to change without notice. Quoted prices include the charter fee and any additional services explicitly stated at booking. Taxes and booking fee are itemized and added to the charter price during checkout.

2. Cancellation and Refund Policy

2.1. Customer Cancellations: Cancellations must be communicated to Boston Sailing and Fishing Charters LLC via by phone [617-583-2760] or email [bostonsailingandfishing@gmail.com]. Our cancellation policy is as follows:

Cancellations made more than 24 hours before the time of charter will receive a full refund.

Cancellations made less than 24 hours before the time of charter will be refunded 50% of the total price of charter.

No-shows or failure to arrive on time will result in forfeiture of the full charter fee.
2.2. Cancellations by Us: We reserve the right to cancel a charter due to unsafe weather conditions, mechanical issues, or other unforeseen circumstances. In such cases, we will offer a full refund or the opportunity to reschedule at no additional cost. We are not responsible for any additional expenses incurred by customers (e.g., travel or accommodation costs).

3. Weather and Safety
​
3.1. Weather Conditions: The safety of our passengers and crew is our top priority. The captain has the final authority to cancel or modify a charter due to adverse weather conditions, including but not limited to high winds, storms, or rough seas. If a charter is canceled due to weather, we will work with you to reschedule or issue a refund as per Section 2.2.
3.2. Safety Compliance: All passengers must follow the captain’s and crew’s instructions at all times. Failure to comply with safety instructions may result in the termination of the charter without a refund.
3.3. Vessel Safety: All vessels are equipped with required safety equipment in compliance with U.S. Coast Guard regulations. Passengers are responsible for wearing provided safety gear (e.g., life jackets) when instructed.

4. Passenger Responsibilities
​
4.1. Conduct: Passengers are expected to behave respectfully toward the crew, other passengers, and the vessel. We reserve the right to terminate a charter without refund if a passenger’s behavior is deemed disruptive, unsafe, or illegal.
4.2. Health and Fitness: Passengers must inform us at the time of booking of any medical conditions, mobility issues, or special needs that may affect their ability to participate safely in the charter. Sailing and fishing activities may involve physical exertion and exposure to the elements.
4.3. Alcohol and Drugs: Alcohol consumption is not permitted on the vessel. Illegal drugs are strictly prohibited. Any alcohol consumption or drug use will result in the termination of the charter without a refund.
4.4. Personal Belongings: Passengers are responsible for their personal belongings. We are not liable for any loss, theft, or damage to personal items brought on board.

5. Fishing Charters
​
5.1.Catch Policy: All fish caught are subject to Massachusetts fishing regulations, including size and bag limits. The crew will assist in ensuring compliance. It is up to the captain's discretion on whether any of the fish caught may be kept by passengers, subject to these regulations, unless otherwise specified.
5.2. Equipment: We provide fishing equipment and bait unless otherwise stated. Passengers cannot bring their own equipment.
6. Assumption of Risk

6.1. Assumption of Risk: Sailing and fishing involve inherent risks, including but not limited to motion sickness, injury from equipment, or accidents due to weather or sea conditions. By participating, passengers acknowledge and accept these risks.
6.2. Liability Waiver: All passengers must sign a liability waiver before boarding. Passengers under 18 must have a waiver signed by a parent or legal guardian.
6.3. Limitation of Liability: Boston Sailing and Fishing Charters LLC is not liable for any personal injury, property damage, or loss incurred during the charter, except where caused by our gross negligence or willful misconduct. Our liability is limited to the cost of the charter.

7. Privacy Policy

We respect your privacy. Any personal information collected during the booking process will be used solely for the purpose of providing our services and will not be shared with third parties, except as required by law.
